Jamaal Howard Executed in Texas for Vickie Swartout Murder After Final Appeals Fail

HUNTSVILLE, Texas — Texas executed Jamaal Howard, 46, by lethal injection Wednesday evening for the 2000 murder of convenience-store clerk Vickie Swartout, ending a capital case that stretched across more than 25 years and a final round of unsuccessful appeals.

Howard was pronounced dead at 8:03 p.m. on October 7 at the state prison in Huntsville after receiving pentobarbital. His execution proceeded after courts rejected efforts to stop it over an intellectual-disability claim and concerns about the execution drug following Tennessee’s failed attempt to execute Christa Pike.

The timing brought national attention to Howard’s case. He became the 30th person executed in the United States in 2026 and the first since Pike survived Tennessee’s September 30 lethal-injection attempt.

Vickie Swartout was killed during a 2000 robbery

Howard was 20 when he killed Vickie Swartout, 42, during a May 12, 2000, robbery at the convenience store where she worked in Silsbee, about 100 miles northeast of Houston.

According to official Texas prison records, Howard shot Swartout once in the chest and took $114 from the cash register. Evidence presented at trial also included surveillance video showing the shooting. Court records cited by the Associated Press said a carton of cigarettes was taken as well.

Howard was convicted of capital murder in Hardin County and received by the Texas prison system on April 26, 2001. He had no prior prison record listed by the state.

Intellectual-disability claim became central to final appeals

Questions about Howard’s mental functioning had been raised for years. A competency proceeding in 2001 ended with a deadlocked jury before another jury later found him competent to stand trial.

His attorneys ultimately argued that Howard had an intellectual disability that made him constitutionally ineligible for execution. Texas disputed whether the evidence satisfied the legal requirements for such a claim.

The issue reached the U.S. Supreme Court during Howard’s final effort to obtain a stay. The justices declined to intervene Wednesday night without issuing a detailed opinion, clearing the way for the execution.

Christa Pike case added a late challenge

Howard’s final days on death row unfolded against extraordinary developments in Tennessee, where Christa Pike survived a September 30 execution attempt despite receiving pentobarbital.

The connection mattered because Texas also uses pentobarbital for lethal injections. Howard’s attorneys raised concerns about the quality of Texas’ execution drugs and sought information about the pentobarbital the state planned to use.

They also sought additional time before the execution. Texas courts rejected requests connected to the execution drugs, and the execution remained scheduled.

Howard apologized to Swartout’s family

Howard addressed members of Swartout’s family in his final statement. He apologized for what happened and asked them to forgive him. He also thanked his friends and relatives and expressed his love for them.

According to an Associated Press witness account, Howard took several breaths and gasped after the pentobarbital began flowing. He then made snoring-like sounds and coughed before becoming still.

Movement stopped within roughly 30 seconds. Howard was pronounced dead 19 minutes after the injection began. His sister, who witnessed the execution from an adjoining room, became distressed and was assisted from the witness area.

Texas carries out seventh execution of 2026

Howard was the seventh person executed by Texas in 2026. The state’s official Texas Department of Criminal Justice execution statistics track executions by year and provide historical totals.

Nationally, Howard became the 30th person executed this year, according to the Associated Press. Florida had carried out 16 executions, the highest number among states at the time.

Pentobarbital scrutiny continues after Howard’s execution

Howard’s death closes a criminal case dating to 2000, but its timing places lethal injection back under scrutiny. Pike survived two doses of pentobarbital in Tennessee, prompting an investigation into what happened and a halt to Tennessee’s remaining scheduled execution for 2026.

That outcome does not establish a problem with Texas’ execution procedure. The cases involved different states and execution protocols. But their proximity has intensified questions about execution-drug sourcing, testing, administration and the information available to prisoners challenging lethal-injection procedures.

For Swartout’s family, the case remains rooted in her killing while working at a Silsbee convenience store and the more than quarter-century that passed before Howard’s death sentence was carried out.
